Participation Statement & Assumption of Risk
We strive to create a positive experience for everyone and take steps to ensure that your time with us is as safe and enjoyable as possible. However, kayaking is not risk free. Kayaking is an adventurous activity, and like all other adventurous activities, it is based on the pursuit of excitement and satisfaction, which is achieved by taking on a controlled exposure to risk. The same elements that contribute to the unique character and fun of adventure sports, such as the physical challenge and risk factor, also cause a higher than normal exposure to potential dangers. We wish to inform you that kayaking is physically exerting, and takes place in an environment that is potentially hazardous to the health and wellbeing of participants. In such an environment, severe accidents can happen without any contributing negligence from Paddle365 or its staff. By agreeing to this participation statement, you should understand that Paddle365 and its associates will not be made liable for any loss, damage, injury, or loss of life that has come about through exposure to the naturally occurring hazards associated with participation in risk-based adventure sport. The risks of engaging in the activity of white water paddle sports include but are not limited to: exposure to cold weather and adverse environmental conditions, impact with rocks in the river bed, musculo-skeletal injuries such as strains and dislocations, and infections from exposure to dirty water. Activities may take place in locations that are remote and difficult to access, and this can cause a delay in medical care should an incident occur. Participation in the sport of kayaking necessitates an assumption of risk from the individual. Finally, these activities are based on challenge by choice. Participants will be presented with challenges over the course of a river kayaking session. It is their choice as to whether to take them up. Should you wish for additional protection, you should consider taking out your own insurance for personal injury and third party liability. Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability which cannot lawfully be excluded under the laws of England and Wales.
Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Terms and conditions
All clients must have read and understood the Participation Statement above. Participants must follow all instructions given to you by staff. Instructions will always be given for a reason, such as to aid your enjoyment or to promote your safety. Failure to listen to instructions can result in expulsion from an activity. Your instructor reserves the right to expel a client or cancel a session at any time if they suspect the session is becoming or has the potential to become unsafe. Reasons for this include, but are not limited to: Unruly behaviour or suspected alcohol or substance abuse; or if the medical, psychological or physical condition of a client is considered by the instructor to make their participation in the chosen activity unsafe. Where possible an alternative activity/solution will be offered to solve the problem if it is reasonable to do so. Please report any suspected injury or negative experience to your instructor at the earliest convenience, ideally before you depart after an activity. This is so that we can record it and continue to work towards making all activities as safe and enjoyable as possible.
Disclosure of medical conditions and additional needs:
We would like to be as accessible an outfitter as possible, and will always do our very best to accommodate to the physical or medical disadvantages of a participant, but we have to know these first! Any medical conditions or injuries must be reported at the time of booking, and any changes to these between booking and the activity should be declared before the start of the activity. These conditions include (but are not limited to) heart conditions, breathing issues, joint problems, vision issues, allergies, asthma, spine/back pain, dizziness and any pre-existing or recent injuries/conditions. People with disabilities are very welcome on our trips, but should declare their disability at the time of booking, so that if necessary, we can engage in a discussion on any additional preparations that might be required.
Service limitations:
Paddle365 provides an outdoor skills coaching and and guiding service. If our service is booked by an individual, club or business, it must be understood that our agreement will be limited to the provision of this specific service alone, and that any incidental extras that the client pays for such as parking, food, facility fees for our chosen venue, or any other, are not included in the price for the paid for service.
Media and photography:
During activities, images and videos may be taken by Paddle365 instructors. These images and videos will be shared with the individuals who attended the course. They may also be used for marketing and promotional purposes, including but not limited to use on our website, social media pages, or other promotional content. If a participant does not wish to appear in photographs or videos, they must inform their instructor on the day of the activity. We will always respect such requests and take reasonable steps to ensure that individual is not included in media capture. If a participant later wishes for any image or video of themselves used by Paddle365 to be removed from our marketing platforms, they may contact us to request its removal. Upon receiving such a request, we will take reasonable steps to remove the material as soon as practicable.

Medical information is collected solely for the purpose of ensuring participant safety. All personal data is stored securely within our database and is accessible only to Paddle365 managers. Relevant information will be shared with the course director or instructor responsible for delivering the activity you have booked in order to help them maintain the safety of participants. In the event of an emergency, relevant information may be shared with medical personnel or emergency services.
Paddle365 processes personal data in accordance with applicable UK data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Age and supervision policy:
The minimum age for participation is:
12 years old for privately organised courses or lessons.
16 years old for publicly advertised courses.
All participants under the age of 18 must have consent provided by their legal parent or guardian prior to participation.
For participants under the age of 18, a care giver authorised by their parent must remain contactable at all times during the activity and no more than 30 minutes from the activity location. This is to ensure that they can respond promptly should the need arise.
Paddle365 reserves the right to refuse participation if appropriate consent has not been obtained or if supervision arrangements are deemed insufficient.
Responsibility for possessions and equipment provided:
During your activity, you remain responsible for your own personal possessions. Any jewellery or valuables should ideally be left behind. Any vehicles should be parked sensibly and securely. You also will have a responsibility to look after the equipment you are provided with for your activity. Should any damages or losses occur due to a participant’s lack of care or deliberate action, we may seek to recover costs from either yourself or your group.
Late arrivals and early departures:
Participants are expected to arrive at the agreed meeting time stated in their booking confirmation. If a participant arrives late, the session may begin without them. We cannot guarantee that a late participant will be able to join the activity once it has commenced, particularly where safety briefings or group logistics have already been completed. No refund will be offered in cases of late arrival. If a group arrives late, the session will still conclude at the originally scheduled finish time. Paddle365 is unable to extend the duration of a session due to late arrival. No refund or partial refund will be offered in such circumstances. If a participant has to leave a course or session before the finish for any reason, this will not entitle the participant to any refund or credit.
Cancellation or Alteration by the Customer:
It may be that a client needs to cancel their booking. They must make Paddle365 aware of this as soon as possible so that alternative arrangement can be made. A client will confirm their booking by making a specified non-refundable deposit. When a client cancels a booking the following time rules will apply regarding any rights to refund, reschedule or payment of unresolved fees.
8+ weeks before the activity: Your deposit may be transferred to another course with Paddle365, but may not be refunded. Any additional course fees paid may be refunded.
4-8 weeks before activity: Your deposit is committed to this course and may not be applied elsewhere. Any additional course fees paid may be transferred to another course, and a cancellation refund of 50% may be obtained.
10 days - 4 weeks before the activity: Rescheduling will incur an admin fee to the value of 50% of the full course, inclusive of deposit value. Cancellation will incur a charge of 75% of the course fee.
Less than 10 days before the activity: The whole cost for the activity will be charged for
cancellation or attempt to reschedule.
Cancellation or Alteration by Paddle365:
In the business of outdoor activity provision instructors make continuous risk assessments to maintain the quality and safety of sessions. Because of the changeable nature of the outdoor environment, bookings can be subject to cancellation or alteration if the conditions on the day dictate. The outdoor activity venue and plan for your river trip is chosen and advertised as an ideal. If however, weather or water conditions at this venue are deemed unsafe or inappropriate on the day by the instructor, an alternative venue that fits with the spirit of the booking may be chosen on the day of the activity, or if one cannot be found the trip may be cancelled. Your Paddle365 Instructor is the only one who can decide this for your trip. If a trip is cancelled by us due to unsuitable conditions on the day, or other unforeseen circumstances, we will discuss potential options as to how we can fulfil our commitment to you, either by rescheduling your trip or offering a refund if an alternative arrangement cannot be found.
